Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN, A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.
- ELIGIBILITY. To enter the Defend Your Pride: Vote The O'Brien Sweepstakes (“Sweepstakes”), you must (a) be a lawful permanent resident of the United States or the District of Columbia; (b) be of legal age of majority in your jurisdiction of residence (and at least 18 years of age or older in the US) at the time of entry; and (c) have an active e-mail account and Internet access as of the beginning of the Sweepstakes Period. This Sweepstakes is void in the excluded states and/or countries identified herein: Puerto Rico, U.S. territories and possessions; outside of the U.S.; and where prohibited by law. This Sweepstakes and any website pages and advertisements relating thereto are intended for viewing only within the United States and District of Columbia. Employees, officers, directors and agents of Davey O’Brien Educational and Charitable Trust d/b/a Davey O’Brien Foundation (“Sponsor”), and its parents, subsidiaries, affiliates, retailers and advertising or promotion agencies, including LComm Marketing and Public Relations, LLC (“Sweepstakes Administrator”), and vendors involved in this Sweepstakes (collectively “Sweepstakes Entities”), and the immediate family (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and household members of all such persons, whether or not related, are not eligible to participate in this Sweepstakes. By entering this Sweepstakes, participants agree to be bound by these Official Rules and the decisions of the Sponsor and/or its agents.
- HOW TO ENTER. The Sweepstakes begins on 12:01am (Central Standard Time "CST") on August 18, 2009, and ends at 12:00pm CST on December 6, 2009 ("Sweepstakes Period"). AUTOMATIC ENTRY: Eligible consumers who register and complete the voting process online at www.VoteOBrien.org (“Website”) in accordance with the on-screen instructions during the Sweepstakes Period will receive one (1) automatic Sweepstakes entry ("Automatic Entry"). Limit one (1) Automatic Entry per eligible entrant. ONLINE ENTRY: To enter online, go to Website, complete the online entry form and submit it in accordance with the on-screen directions during the Sweepstakes Period. PAPER ENTRY: During the Sweepstakes Period a paper entry form (“Entry Form”) may be offered at the discretion of the Sponsor. To enter using the Entry Form, Entrant must fill out all sections of the Entry Form. Entry Form must be returned to Sponsor. Sponsor will enter information from Entry Form onto website. Once Entrant’s information has been entered, Entrant will automatically be entered in the Sweepstakes. Online Entries and voting must be manually key-stroked; use of automated entry devices or programs is prohibited. If an Entrant changes his/her phone number, e-mail address or postal address after he/she enters the Sweepstakes, it is his/her sole responsibility to notify the Sweepstakes Administrator by mailing notice to the Sweepstakes Administrator’s address (see Section 10 for additional information), and such notice must be received on or before the end of the Sweepstakes Period. Limit one (1) Online Entry per person and e-mail address. Sweepstakes Entities are not responsible for malfunctions of electronic equipment, computer hardware, software, malfunctions of the entrant's e-mail provider or referral e-mail address, incorrect e-mail addresses, lost, late, incomplete, illegible, postage-due or misdirected entries. Entrant may cast one vote a day but will only be entered into Sweepstakes once. MULTIPLE VOTES DO NOT INCREASE CHANCES OF WINNING.
- PRIZE–ONE (1) GRAND PRIZE
Total Approximate Retail Value (ARV) of Grand Prize: $2,500 USD.
- Two (2) tickets for the 2010 Davey O’Brien Awards Dinner in Fort Worth, TX on or about February 15, 2010 (ARV $700 USD).
- Two (2) tickets for the Welcome Reception & Dinner in Fort Worth, TX on or about February 14, 2010. (ARV: $24 USD).
- Roundtrip airfare for Grand Prize Winner and one (1) guest to Fort Worth, Texas. SPONSOR reserves the right to substitute air transportation with ground transportation if Grand Prize Winner and his/her one (1) guest reside within 150 miles of hosting city (ARV $1,000 USD).
- Two (2) nights standard hotel accommodations (“Hotel”) in Fort Worth, Texas, for Grand Prize Winner and one (1) guest (one room, double occupancy, room and tax only) (ARV $450 USD).
- Ground transportation between the airport and Hotel on arrival and departure, to and from Welcome Dinner, and to and from the Davey O’Brien Awards Dinner (ARV: $250 USD).
- Prize Conditions: AIRLINE TICKETS: Travel must occur on a date and time concurrent with the Awards Dinner date currently scheduled for February 15, 2010, or other such date as determined by Sponsor. Travel must be arranged with Sponsor a minimum of thirty (30) days in advance, and is subject to availability and Sponsor's approval. If Grand Prize Winner is unable to fulfill Grand Prize during time period, Grand Prize Winner forfeits the Grand Prize and an alternate winner will be selected. All travel dates will be determined by the Sponsor, and once made, may not be altered except by Sponsor. Grand Prize Winner and Guest must travel with the same itinerary and on the dates and/or times specified by Sponsor or prize will be forfeited and awarded to an alternate winner. Sponsor is not responsible for any costs, taxes, fees, and expenses associated with or incurred during air travel. HOTEL ACCOMODATIONS: The Hotel accommodations do not include meals, incidentals, tips, telephone calls, or any other personal expenses incurred during the trip. DAVEY O’BRIEN AWARDS DINNER: There is a mandatory “Black Tie” dress code for the Awards Dinner. All persons attending the Awards Dinner must wear formal attire. Grand Prize Winner and Guest are responsible for providing their own attire. Sponsor Entities are in no way responsible for providing appropriate attire to Grand Prize Winner and Guest and will not be held liable for Winner and/or Guest not being allowed to attend Awards Dinner for lack of appropriate attire. Guest of potential Grand Prize Winner must be at least eighteen (18) years of age or older, unless Grand Prize Winner is his/her parent or legal guardian, and both must sign a Liability and Publicity Release. All documents must be returned by the date and/or time indicated within such documents. No payments will be made to third parties. All other expenses not specifically identified as included in the Grand Prize are the sole responsibility of the Grand Prize Winner. All costs, taxes, fees, and expenses associated with any element of a prize not specifically addressed above are the sole responsibility of the Grand Prize Winner. All federal, state and local taxes on the prize are Grand Prize Winner's responsibility. The potential Grand Prize Winner will be required to execute an Affidavit of Eligibility, a Liability Release, and a Publicity Release ("Affidavit/Release"). The Grand Prize Winner will also be issued a 1099 tax form for the ARV of Grand Prize. Such documents must be returned by the date and/or time indicated within such documents. If a potential Grand Prize Winner and/or Grand Prize Winner's Guest fail to return such documents within that time, or if an entrant is found to be ineligible, or if he/she does not comply with the Official Rules, then the potential Grand Prize Winner may be disqualified and an alternate winner selected. If prize or prize notification is returned as undeliverable, this will result in disqualification and an alternate winner will be selected. Except where prohibited by law, Winner's acceptance of the prize will be posted on Sponsor’s website and constitutes permission of such participant for Sponsor and its designees to use, without notice, permission or further compensation, worldwide, and in perpetuity, in any and all forms of media, now known and hereafter devised, including, without limitation, on the Sponsor website, winner's first name, last name, city and state, photograph, likeness, voice, and/or voice likeness for purposes of advertising, trade, promotion and publicity. The specifics of all aforementioned elements of any prizes in the Sweepstakes shall be solely determined by Sponsor. Some restrictions may apply. No substitution, transfer of any prize (or any part of a prize package) or cash alternative permitted, except by Sponsor in which case a prize of equal or greater value will be awarded.
- Limitations of Liability: Grand Prize Winner, Guest and Entrants also agree to release, discharge, indemnify and hold harmless the Sweepstakes Entities, and each of their respective officers, directors, employees, representatives and agents from and against any claims, damages or liability due to any injuries, damages or losses to any person (including death) or property of any kind resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of any prize or participation in any Sweepstakes-related activity or participation in this Sweepstakes. Sweepstakes Entities are not responsible for lost, late, misdirected, undeliverable or incomplete on-line entries due to system errors, failures or any technical malfunctions which may limit an entrant's ability to participate. If for any reason this Sweepstakes is not capable of running as planned, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, or any other causes beyond the reasonable control of Main Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the promotion, then Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes. Sponsor is not responsible for any typographical or other printing errors in the offer or administration of the Sweepstakes, including, but not limited to, errors in the printing of posting of the offer or in these Official Rules, the selection or announcement of the winner, or the distribution of any prizes.
- Drawing and Notification of Winner: Potential Grand Prize winner will be selected in a random drawing on or about December 14, 2009, by the Sweepstakes Administrator, an independent judging organization, whose decisions on all matters relating to the Sweepstakes will be final and binding. The Potential Grand Prize Winner will be notified by phone, e-mail, and/or Federal Express (at the phone number, e-mail address or address provided at the time of receiving Entrant's Entry) at the Sponsor’s sole discretion. Entrants need not be present at the drawing to win. If potential Winner cannot be reached after a reasonable effort has been exerted; he/she is found to be ineligible; he/she cannot or does not comply with these Official Rules; and/or if his/her prize or prize notification is returned as undeliverable, potential Winner will be disqualified, and an alternate potential Winner will be selected at random from the remaining Entries. Potential Winners will be required to sign, notarize and return an Affidavit of eligibility and mutually acceptable Liability and Publicity Releases (where permitted by law) within the date and/or time indicated within such documents, or the prize will be forfeited in its entirety and an alternate winner will be selected. Grand Prize Winner's Guest must also sign, notarize and return an Affidavit of Eligibility and mutually acceptable Liability Release and Publicity Release prior to the trip. Grand Prize Winner will also be required to complete and furnish a W-9 Form, including his/her Social Security number, which will be used only for the purpose of reporting the Winner's prize earnings to the Internal Revenue Service as required by law.
- SWEEPSTAKES CONDITIONS. This Sweepstakes is subject to these Official Rules and all applicable federal, state, provincial and local laws and regulations (collectively "Rules and Laws"). Notwithstanding anything to the contrary in Sponsor's privacy policy available at www.DaveyOBrien.org, as amended from time to time, and except where prohibited by law. Sponsor reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes; to be acting in violation of these Official Rules, or to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person; and all associated Entries will be void. CAUTION: ANY ATTEMPT BY AN ENTRANT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH ENTRANT TO THE FULLEST EXTENT OF THE LAW, AND TO NOTIFY LAW ENFORCEMENT AUTHORITIES WHO MAY PURSUE CRIMINAL PROSECUTION. In the event Sponsor is prevented from continuing with this Sweepstakes (or any portion thereof), or the integrity and/or feasibility of the Sweepstakes (or any portion thereof) is undermined by any event or cause (each a "Force Majeure" event), Sponsor shall have the right, in its sole discretion, to abbreviate, modify, suspend, cancel or terminate the Sweepstakes without notice or further obligation. If the Sponsor, in its discretion, elects to abbreviate the Sweepstakes (or any portion thereof) as a result of a Force Majeure event, the Sponsor reserves the right, but shall have no obligation, to award the prize for the drawing at issue from among all non-suspect eligible Entries received for such drawing up to the time of such Force Majeure event.
- LIMITATIONS OF LIABILITY. By submitting an Entry, each entrant agrees and acknowledges to be bound by the Rules and Laws, as well as the decisions of Sponsor and Sweepstakes Administrator, whose decision shall be binding and final; to waive any rights to claim ambiguity with the Rules and Laws, and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in Sweepstakes; acceptance/possession (including, but not limited to, delays by shipping companies), defects, and/or use/misuse of a prize; human error; incorrect or inaccurate transcription of Entry information; typographical, printing or other error in the printing of these Official Rules or in any Sweepstakes-related information; administration of the Sweepstakes, the processing of Entries or in the announcement of prizes (including such error as may give an erroneous indication that a prize has been won); any technical malfunctions of the telephone network, computer online system, computer equipment, or software utilized by Sweepstakes; or any hardware or software compatibility problems on account of technical problems or human error, or combination thereof; any lost/delayed data transmissions, omissions, interruptions, defects; and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. Each Entrant further agrees to indemnify and hold harmless Sweepstakes Entities from any and all injuries, losses, damages, claims, actions or any liability resulting or arising from participation in this Sweepstakes or acceptance, possession or use of a prize, and to release all rights to bring any claim, action or proceeding against Sweepstakes Entities. Sweepstakes Entities shall not be liable for any injury, damage, loss, expense, accident, delay, inconvenience or irregularity that may be caused or contributed to (1) by any wrongful, negligent or unauthorized act or omission on the part of any of their agents, servants, employees or independent contractors; (2) by any wrongful, negligent or unauthorized act or omission on the part of any other person or entity not an employee of a Sponsor; or (3) by any other cause, condition or event whatsoever beyond the control of Sponsor or its parents, subsidiaries and affiliated companies.
